These terms apply to any use of the BirthdayDeals platform, all related websites, subdomains, mobile applications, email and marketing channels, prize draws, promotions and all other services and communications offered under or on behalf of BirthdayDeals.
The terms also apply to current and future platforms, brands or domain names owned or managed by BirthdayDeals, insofar as they have the same or a similar purpose.
By using any of these services, the user accepts that the provisions of these terms apply in full to any use within this network of platforms.
By using the platform or registering, the user declares to have fully read and unconditionally accept these terms.
BirthdayDeals's services are aimed at consumers and partners who share information or promotions via the platform.
The user guarantees to provide correct, current and complete data and indemnifies BirthdayDeals for damages due to incorrect or false information.
The user remains fully responsible for actions that take place under their account.
Access to certain parts may depend on age, place of residence or legal restrictions.
Users under eighteen years of age need permission from a parent or guardian; explicit parental consent is required for processing data of persons under sixteen.
BirthdayDeals may request proof of consent at any time; in its absence, access or participation will be terminated.
All prize draws on the platform are promotional games of chance in accordance with the Promotional Games of Chance Code of Conduct and are accessible at no cost.
Each campaign has a clear description, duration and prize overview published via the platform.
A user can only participate once per campaign, unless explicitly stated otherwise.
Entries with incomplete or incorrect data are invalid.
Automatic submissions, scripts or bots are prohibited and lead to exclusion.
The drawing of prizes takes place randomly and verifiably; afterwards, a manual check on age and validity takes place.
Only after confirmation by the team is a winner definitively established.

Partner companies that publish deals are themselves responsible for correct delivery, prices and compliance with legislation.
BirthdayDeals checks partners for reasonableness but does not guarantee the availability or quality of the offers.
In the event of a dispute about a deal, the user is obliged to resolve this directly with the relevant partner.
BirthdayDeals may block user or partner accounts in case of fraud or deception.
All content on the platform, including logos and texts, remains the property of BirthdayDeals.
Use of brand or image material without permission is prohibited.
By submitting material, the user grants a limited licence for use for promotional purposes.
The user guarantees that submitted material does not infringe on third‑party rights.
BirthdayDeals is not liable for claims from third parties arising from content placed by users.
Any gambling tax on prizes won is, if legally required, for the account of the winner.
Prizes may differ from the images shown; an equivalent alternative may be delivered.
The participant indemnifies BirthdayDeals for damage resulting from incorrect or incomplete data.
All communication between user and platform may be logged for evidence and security purposes.
BirthdayDeals processes data within the EU or according to equivalent levels of protection.
Using the platform for unlawful purposes is prohibited.
The user will not spread viruses, spam or unwanted advertising via the platform.
Abuse may lead to legal action or reporting.

The user can delete their account at any time; remaining rights lapse upon deletion.

Any incorrect point counts do not give any right to payment or benefit.
Users declare to refrain from offensive or discriminatory statements.
In case of violation, access may be permanently denied.

The total value of the prizes per campaign remains below the maximum permitted by the code of conduct.
There is no favouritism based on purchases or payments.

BirthdayDeals strives to handle complaints within thirty days.
If a dispute cannot be settled amicably, the competent court has jurisdiction.
All agreements are governed by local law.
If a provision is invalid, the remaining provisions remain in force.
In case of invalidity, the parties will agree on a new provision that is as close as possible to the original intent.
Correspondence is conducted in English.
All prices and amounts are inclusive of VAT unless otherwise stated.
Printing or typographical errors do not bind BirthdayDeals.
BirthdayDeals may adjust promotional rewards without prior notice.
Users declare that participation is entirely voluntary.
Using the platform does not create an employment relationship.
Partners are themselves responsible for compliance with labour and youth legislation in promotional activities.
BirthdayDeals reserves all rights not explicitly granted to users.
Failure to enforce a provision does not constitute a waiver of rights.
No part of these terms creates rights for third parties.
All amounts are stated in euros.
Communication by email is deemed to have been received within 24 hours of sending.
Proof of sending serves as proof of receipt.
These terms replace all previous versions.

Users are advised to consult the terms regularly.
By using the platform, the user declares to be fully aware of all articles.
Every participation or registration implies the acceptance of these complete terms.
BirthdayDeals may publish additional rules for specific campaigns or features at any time.
BirthdayDeals may use collected data, provided in accordance with privacy legislation and only after consent or where legally permitted, for future services or affiliated platforms that have the same or a similar purpose.
These terms come into effect on the date of publication and remain valid until they are replaced by a new version.
The term 'Main Prize', as referred to in these terms and conditions, refers to a single, one‑time prize that will be drawn when the number of members mentioned in Article 22 is reached. The winner of this main prize has the right to choose from a pre‑determined prize package. This package may consist of options such as (a) a cash amount, (b) a physical product, or (c) gift cards. The exact composition and value of the prize package will be announced prior to each campaign period. The visual representations on the platform serve as illustrations of the available choices and may differ from the actual offer. The winner's choice is final and cannot be exchanged for other prizes, cash, or alternative monetary value. Per campaign period, only one main prize will be awarded to one winner.
